General conditions

1. General
CISKA PETERS EVENTS (CPE) uses as a basis the general terms of delivery from CLC-VECTA, of which you will find a copy enclosed. Further more CPE uses a few specific or deviating conditions which apply to all her proposals and contracts concerning sales and conferment of services as well as deliverance of goods. These conditions overrule the general terms of delivery from CLC-VECTA at all times.

With sales and conferment of services / deliverance of goods we mean: the organization of events, party’s and exploitations in the broadest meaning in which are also included: supply of catering, entertainment, decorative elements, audio/visual equipment, personnel, locations, transportation etc.

2. Proposals/contracts
CPE always, unless mentioned otherwise, makes the first proposal without engagement. Prices are valid throughout the period mentioned and only apply to that specific proposal. Unforeseen rising of prices, which are not caused by CPE, as well as adding flaws may be invoiced with the final contract. A contract made by CPE, which has been signed by both parties, will be a binding contract has been made.

3. Payment conditions
After signing the contract, a deposit has to be paid of 50% (VAT included) of the total amount mentioned in the contract, unless a different arrangement has been made between the two parties. 45% has to be paid at our account two weeks before the date of the event. Payment of the remaining amount, will have to be paid at the latest 14 days after the last invoice date. You will receive a separate invoice for each payment. invoice of the Vecta Guarantee fund will be sent separately, together with the first invoice.

4. Production fee and accompaniment hours
The production fee for the services of CPE amounts of 15% over the amount which will be invoiced in the end, with minimum of € 2.500,00. This fee holds the following services:

  • administration costs
  • development and presentation of the proposal
  • composing calculations and securing the budget
  • contracting suppliers and coordinating them, regarding to: transportation, locations, entertainment, catering, technical facilities etc.
  • creating and adjusting of elaborate time schedules
  • evaluation of the event with the client

Depending on the art of the event, it’s possible that we pass on operational hours which are made on the day of the event by personnel of CPE. In this case we will calculate an estimated amount in the proposal, based on:

  • senior - producer € 115,00
  • per hour,producer € 80,00 per hour
  • ass.-producer € 65,00 per hour

5. Number of guests
In case the number of guests is of influence to the services, which CPE executes on behalf of her client, the following rules will apply:

  • Alterations in the number of guests have no financial consequences until three months before event date.
  • Alterations in the number of guests until 14 days before event date to a maximum of 25 % of the mentioned amount of guests, have no financial consequences.
  • Alterations in the number of guests until 7 days before event date to a maximum of 10 % of the mentioned amount of guests, have no financial consequences.
  • Alterations in the number of guests always have to be communicated as soon as possible to CPE. No guarantees can be given by CPE when these changes take place until 3 days before the event date.

6. . Location reservations
When CPE rents a location on behalf of her client, the specific conditions used by this location, also apply.

7. Cancellation
In case a certain service which is part of the contract, as mentioned in article 2, has been arranged by CPE and it is cancelled by her client, the following conditions apply:

  1. When cancellation takes place more than 12 months before the time on which the specific service was supposed to be delivered, there will be no financial consequences for the client.
  2. When cancellation takes place more than 6 months before this time, the client will have to pay 15% of the total amount (VAT included), as mentioned in the contract, to CPE.
  3. When cancellation takes place more than 2 months before this time, the client will have to pay 35% of the total amount (VAT included), as mentioned in the contract, to CPE.
  4. When cancellation takes place more than 14 days before this time, the client will have to pay 75% of the total amount (VAT included), as mentioned in the contract, to CPE.
  5. At cancellation within 14 days before this time, the client has to pay 100% of the total amount (VAT included), as mentioned in the contract, to CPE.

Concerning the conferment of services by third parties, such as entertainment, audiovisual facilities and locations, the conditions of cancellation of this particular party apply.

8. Loss and damage
In case goods, which have been supplied or rented by CPE, are missing, damaged or broken, the client will have to pay the amount which will be necessary to replace the item(s) to CPE, unless CPE and/or one of her suppliers can be blamed for malicious intent or negligence.

9. Superior forces
In case of demonstrable superior forces CPE can, after notifying her client, cancel the execution of the entire event. Such situations are, for sure:

  • Governmental regulations and requests which have to be fulfilled
  • Public collisions
  • Strikes
  • Disturbances in the supply of goods delivered by third parties, as well as supply of water and electricity
  • Break-down of the equipment which is necessary for an adequate execution of the services of CPE
  • Fire or accidents

10. Surplus costs
In case surplus costs are made during the time between signing the contract and the event date, CPE will ask for the approval by the client at all times, preferably in writing. The surplus costs will in that case be invoiced simultaneously with the final invoice.

11. Copyright:
The copyright on an event remains with CISKA PETERS EVENTS at all times and cannot be transferred.

12. Buma
The client will, as final consumer, pay the money for the musical rights which apply to the event, directly to the BUMA organization. The responsibility and risk involved in the (non-)payment of these rights are entirely with the client, who is also the final consumer.

13. Disputes
Contracts, instigated by CPE, for which these conditions are valid, the Dutch law is applicable. All disputes will be submitted to the competent court.
